केंद्र सरकार ने लोकसभा में तीन अहम विधेयक पेश किए हैं। केंद्रीय गृह मंत्री अमित शाह ने बुधवार को 130वां संविधान संशोधन विधेयक लोकसभा में पेश किया। इस दौरान जमकर हंगामा देखने को मिला। विपक्षी सांसदों ने बिल का विरोध किया। उन्होंने विधेयक की कॉपी सदन में ही फाड़ दिया और इसे केंद्रीय गृह मंत्री के ऊपर फेंक दिया। 

  


केंद्रीय गृह मंत्री अमित शाह ने लोकसभा में संविधान (एक सौ तीसवां संशोधन) विधेयक, 2025, केंद्र शासित प्रदेश सरकार (संशोधन) विधेयक, 2025, जम्मू और कश्मीर पुनर्गठन (संशोधन) विधेयक, 2025 पेश किया। उन्होंने विधेयक पेश करते हुए कहा कि भारत के संविधान का संशोधन करने वाले विधेयक को स्थापित करनी की अनुमति दी जाए। जम्मू-कश्मीर पुर्नगठन संशोधन स्थापित करने की अनुमति दी जाए। मैं प्रस्ताव करता हूं संघ राज्य क्षेत्र शासन अधिनयम 1963 वाले विधेयक को स्थापित करने की अनुमति दी जाए।

बिल की प्रतियां फाड़कर शाह की ओर फेंकी गईं
जिसपर लोकसभा में विपक्ष ने भारी विरोध किया। कांग्रेस सहित सभी विपक्षी दल ने तीनों बिल का भारी विरोध किया और उसे वापस लेने की मांग भी की है। लोकसभा में संविधान (एक सौ तीसवाँ संशोधन) विधेयक, 2025, केंद्र शासित प्रदेश सरकार (संशोधन) विधेयक, 2025, जम्मू और कश्मीर पुनर्गठन (संशोधन) विधेयक, 2025 की प्रतियाँ फाड़कर गृह मंत्री अमित शाह की ओर फेंकी गईं।

गृहमंत्री के माइक को मोड़ने की कोशिश
सदन में हंगामे के बाद अमित शाह ने कहा कि इस बिल को संयुक्त समिति को भेजने का प्रस्ताव किया। राज्यसभा और लोकसभा के सदस्यों की समिति बनेगी। सत्ताधारी दल की तरफ जिसे ट्रेज़री बेंच कहते हैं उसे विपक्षी सांसदों ने घेर लिया और गृहमंत्री के माइक को मोड़ने की कोशिश की गई। जमकर हंगामा हुआ और सदन के अंदर स्थिति तनाव ग्रस्त हो गई। सत्ता पक्ष की तरफ से भी कई सांसदों ने गृहमंत्री के बचाव में आकर विपक्षी सांसदों को रोकने की कोशिश की। सत्ता पक्ष से रवनीत बिट्टू, कमलेश पासवान, किरण रिजिजू, शतीश गौतम ने गृहमंत्री के पास नारा लगा रहे आक्रमक सांसदों को रोकने का प्रयास किया। 

हंगामे के बाद कार्यवाही स्थगित
संसद के वेल में नारेबाजी की शुरुआत टीएमसी के सांसदों ने की। टीएमसी सांसदों ने बिल इंट्रोड्यूस होने के वक्त से ही लगातार वेल में नारेबाजी शुरू कर दी थी। बाद में कांग्रेस सांसद और महासचिव के सी वेणुगोपाल ने अपनी सीट से ही बिल की कॉपी फाड़कर उछाल दी। उसके बाद सारे कांग्रेस सांसद वेल में उतर गए। वेणुगोपाल के बाद धर्मेंद्र यादव ने भी बिल की कॉपी अपनी सीट से ही फाड़कर फेंक दी और सभी समाजवादी पार्टी सांसद वेल में उतर गए। बाद में जब गृहमंत्री बिल को प्रस्थापित कर रहे थे तब सभी विपक्षी दल के संसद लोकसभा वेल में उतरकर जबरदस्त हंगामा करते नजर आए और एक बार हालत बिगड़ते हुए नजर आए। सभा की कार्यवाही को स्थगित करना पड़ा।

केंद्र की नरेन्द्र मोदी सरकार आज अहम बिल पेश करने जा रही है। इस बिल में ऐसा प्रावधान है कि कोई भी मंत्री, मुख्यमंत्री या यहां तक कि प्रधानमंत्री भी अगर किसी अपराध में गिरफ्तार होकर लगातार 30 दिन तक हिरासत में रहता है तो उसे पद से हटना पड़ेगा। ये प्रस्तावित कानून केवल राज्यों और केंद्र शासित प्रदेशों के मंत्रियों और मुख्यमंत्रियों पर ही नहीं, बल्कि केंद्र के मंत्रियों और प्रधानमंत्री पर भी लागू होगा।

  


अमित शाह बुधवार को लोकसभा में तीन महत्वपूर्ण विधेयक पेश करने जा रही है। इन विधेयकों का उद्देश्य यह है कि अगर प्रधानमंत्री, केंद्रीय मंत्री, किसी राज्य के मुख्यमंत्री या केंद्र शासित प्रदेश के मंत्री को गंभीर आपराधिक मामलों में गिरफ्तार या हिरासत में लिया जाता है तो उन्हें उनके पद से हटाया जा सके। सरकारी सूत्रों के मुताबिक, मौजूदा कानूनों में ऐसा कोई स्पष्ट प्रावधान नहीं है जिससे गिरफ्तारी या न्यायिक हिरासत की स्थिति में ऐसे नेताओं को उनके पद से हटाया जा सके। इसी कमी को दूर करने के लिए सरकार ने ये तीन विधेयक तैयार किए हैं।

संसद में आज जो बिल पेश किए जाएंगे,  ये विधेयक हैं: केंद्र शासित प्रदेश सरकार (संशोधन) विधेयक 2025; संविधान (130वां संशोधन) विधेयक 2025 और जम्मू-कश्मीर पुनर्गठन (संशोधन) विधेयक 2025। केंद्रीय गृह मंत्री अमित शाह इन तीनों विधेयकों को संसद की एक संयुक्त समिति को भेजने के लिए लोकसभा में एक प्रस्ताव भी पेश करेंगे।

30 दिन लगातार हिरासत में रहने पर छोड़ना होगा पद
संविधान संशोधन विधेयक में धारा 75 में नया क्लॉज़ 5(ए) जोड़ने का प्रस्ताव है। इसके अनुसार यदि कोई मंत्री 30 दिन लगातार गिरफ्तार रहकर हिरासत में रहता है और उस पर ऐसा आरोप है जिसमें पांच साल या उससे अधिक की सजा हो सकती है, तो राष्ट्रपति प्रधानमंत्री की सलाह पर 31वें दिन उसे पद से हटा देंगे। अगर प्रधानमंत्री 31वें दिन तक यह सलाह नहीं देते तो भी वह मंत्री अपने आप पद से मुक्त हो जाएगा।

प्रधानमंत्री पर भी लागू होगा ये नियम
इसी तरह प्रधानमंत्री पर भी नियम और कड़े होंगे। अगर पीएम लगातार 30 दिन हिरासत में रहते हैं तो उन्हें 31वें दिन इस्तीफा देना होगा। अगर इस्तीफा नहीं देते तो वे अपने आप प्रधानमंत्री पद से हट जाएंगे। हालांकि, ऐसे मंत्री या प्रधानमंत्री रिहाई के बाद दोबारा नियुक्त हो सकते हैं। यही प्रावधान राज्यों और केंद्र शासित प्रदेशों के मुख्यमंत्रियों और मंत्रियों पर भी लागू होगा।

कांग्रेस ने केंद्र सरकार पर साधा निशाना 
वहीं कांग्रेस ने इन विधेयकों को लेकर केंद्र सरकार पर तीखा हमला किया है। कांग्रेस ने आरोप लगाया है कि भाजपा सरकार इन विधेयकों के जरिए विपक्षी दलों के मुख्यमंत्रियों को निशाना बनाना चाहती है। कांग्रेस प्रवक्ता और वरिष्ठ नेता अभिषेक मनु सिंघवी ने कहा कि भाजपा विपक्ष को कमजोर करने के लिए कानून का दुरुपयोग कर रही है। उन्होंने कहा कि केंद्र सरकार की योजना है कि केंद्र की एजेंसियों से विपक्षी नेताओं को मनमाने ढंग से गिरफ्तार कराया जाए और फिर नए कानून के तहत उन्हें तुरंत पद से हटा दिया जाए।

सुप्रीम कोर्ट ने अपने एक फैसले में सभी राज्यपालों को विधानसभा से पारित विधेयक को मंजूरी देने की समयसीमा तय कर दी थी। इस पर ही राष्ट्रपति ने सुप्रीम कोर्ट से सवाल पूछे थे। सुप्रीम कोर्ट के संविधान पीठ ने राष्ट्रपति द्रौपदी मुर्मू की ओर से भेजे गए संदर्भ पर केंद्र सरकार और देश के सभी राज्यों और केंद्र शासित प्रदेशों को नोटिस जारी कर एक सप्ताह में जवाब मांगा है। इस मामले में अब अगली सुनवाई 29 जुलाई को होगी, जिसमें समय-सीमा तय करने पर विचार होगा। 

विधानसभा से पारित विधेयकों पर राष्ट्रपति और राज्यपाल कब तक फैसला लेंगे? क्या इस पर कोई समयसीमा तय की जा सकती है? मंगलवार को सुप्रीम कोर्ट की संविधान पीठ में इस संवैधानिक सवाल पर सुनवाई हुई। अदालत ने साफ किया कि यह केवल एक राज्य का नहीं बल्कि पूरे देश के लिए मुद्दा है। इसलिए केंद्र सरकार और सभी राज्य सरकारों को नोटिस जारी कर 29 जुलाई तक विस्तृत जवाब मांगा गया है।

अगस्त के मध्य से शुरू होगी सुनवाई
इस मामले पर सुनवाई के लिए चीफ जस्टिस बी. आर. गवई की अध्यक्षता वाली पांच सदस्यीय पीठ गठित की गई है। इस पीठ में जस्टिस सूर्यकांत, जस्टिस विक्रम नाथ, जस्टिस पी. एस. नरसिम्हा और जस्टिस ए. एस. चंदुरकर हैं। पीठ ने साफ किया कि अगस्त मध्य से इस मुद्दे पर नियमित सुनवाई शुरू हो सकती है।

राष्ट्रपति ने क्या कहा?
जिसके बाद राष्ट्रपति द्रौपदी मुर्मू ने संविधान के अनुच्छेद 143 (1) के तहत मिली शक्तियों का इस्तेमाल करते हुए सुप्रीम कोर्ट के फैसले पर सवाल उठाए थे। संविधान का अनुच्छेद 143(1) राष्ट्रपति के सुप्रीम कोर्ट से विचार-विमर्श करने से संबंधित है। इसमें कहा गया है, 'यदि किसी भी समय राष्ट्रपति को ऐसा प्रतीत हो कि किसी कानून या तथ्य का लेकर कोई सवाल उठ रहा है, या उठ सकता है, जो सार्वजनिक महत्व का हो तो उस पर सर्वोच्च न्यायालय की राय ली जा सकती है। राष्ट्रपति उस सवाल को सर्वोच्च न्यायालय के पास भेज सकता हैं और न्यायालय, सुनवाई के बाद राष्ट्रपति को उस सवाल पर अपनी राय से अवगत करा सकता है।'

राष्ट्रपति मुर्मू ने सुप्रीम कोर्ट से पूछे ये 14 सवाल
1. राज्यपाल के समक्ष अगर कोई विधेयक पेश किया जाता है तो संविधान के अनुच्छेद 200 के तहत उनके पास क्या विकल्प हैं?
2. क्या राज्यपाल इन विकल्पों पर विचार करते समय मंत्रिपरिषद की सलाह से बंधे हैं?
3. क्या अनुच्छेद 200 के तहत राज्यपाल द्वारा लिए गए फैसले की न्यायिक समीक्षा हो सकती है?
4. क्या अनुच्छेद 361 राज्यपाल द्वारा अनुच्छेद 200 के तहत लिए गए फैसलों पर न्यायिक समीक्षा को पूरी तरह से रोक सकता है?
5. क्या अदालतें राज्यपाल द्वारा अनुच्छेद 200 के तहत लिए गए फैसलों की समयसीमा तय कर सकती हैं, जबकि संविधान में ऐसी कोई समयसीमा तय नहीं की गई है?
6. क्या अनुच्छेद 201 के तहत राष्ट्रपति द्वारा लिए गए फैसले की समीक्षा हो सकती है?
7. क्या अदालतें अनुच्छेद 201 के तहत राष्ट्रपति द्वारा फैसला लेने की समयसीमा तय कर सकती हैं?
8. अगर राज्यपाल ने विधेयक को फैसले के लिए सुरक्षित रख लिया है तो क्या अनुच्छेद 143 के तहत सुप्रीम कोर्ट को सुप्रीम कोर्ट की सलाह लेनी चाहिए?
9. क्या राज्यपाल और राष्ट्रपति द्वारा क्रमशः अनुच्छेद 200 और 201 के तहत लिए गए फैसलों पर अदालतें लागू होने से पहले सुनवाई कर सकती हैं। 
10. क्या सुप्रीम कोर्ट अनुच्छेद 142 के द्वारा राष्ट्रपति और राज्यपाल की संवैधानिक शक्तियों में बदलाव कर सकता है?
11. क्या अनुच्छेद 200 के तहत राज्यपाल की मंजूरी के बिना राज्य सरकार कानून लागू कर सकती है?

क्या है मामला?
इस पूरे मामले की शुरुआत 8 अप्रैल को तब हुई, जब सुप्रीम कोर्ट ने आर्टिकल 142 का इस्तेमाल करते हुए एक फैसला दिया था। इस फैसले में राष्ट्रपति के लिए एक समय सीमा तय की गई थी। कोर्ट ने कहा था कि राज्यपाल द्वारा राष्ट्रपति के विचार के लिए रखे गए विधेयकों को राष्ट्रपति को तीन महीने के अंदर मंजूरी देनी होगी। जस्टिस जे बी पारदीवाला की अध्यक्षता वाली दो जजों की बेंच ने यह फैसला सुनाया था।

संसद का मॉनसून सत्र जल्द ही शुरू होने वाला है। संसद का मॉनसून सत्र 21 जुलाई से 2025 से शुरू होने जा रहा है। ये सत्र 21 अगस्त तक चलेगा। इस सत्र में केंद्र सरकार कई महत्वपूर्ण विधेयक पेश करने की तैयारी में है। वहीं, विपक्ष भी विभिन्न मुद्दों पर सरकार को घेरने की रणनीति बना चुका है।

  


नया आयकर विधेयक पारित कराने की तैयारी
खबर है कि केंद्र की नरेंद्र मोदी सरकार इस मॉनसून सत्र में नया आयकर विधेयक को संसद की मंजूरी दिलाने की तैयारी में है। यह विधेयक पिछले सत्र में पेश हुआ था और फिर संयुक्त संसदीय समिति को भेजा गया था. सरकार की तरफ से वित्त मंत्री ने फरवरी में संसद में बताया था कि नया विधेयक 1961 के आयकर अधिनियम की जटिलताओं को दूर करेगा और इसे आम लोगों के लिए समझना आसान बनाएगा. यदि यह विधेयक इस सत्र में पारित हो जाता है तो यह कानून 1 अप्रैल 2026 से प्रभावी होगा 

जस्टिस वर्मा पर महाभियोग का प्रस्ताव
इसके साथ ही आठ नए विधेयकों को भी पेश किया जाएगा। लोकसभा की एक आंतरिक बुलेटिन के अनुसार, इनमें खेलों में नैतिक आचरण और सुशासन सुनिश्चित करने के लिए एक राष्ट्रीय खेल प्रशासन विधेयक और देश की भू-वैज्ञानिक विरासत के संरक्षण से जुड़ा एक महत्वपूर्ण विधेयक भी शामिल है। इसके अलावा, हाईकोर्ट के जज जस्टिस यशवंत वर्मा के खिलाफ महाभियोग प्रस्ताव भी संसद में लाया जा सकता है। घर में भारी मात्रा में नकदी मिलने के बाद जस्टिस वर्मा सवालों के घेरे में हैं।
