रिश्वत आरोप में निलंबित IAS अभिषेक प्रकाश की होगी बहाली, 14 मार्च के बाद से प्रभावी मानी जाएगी
लखनऊ। प्रदेश सरकार ने निलंबित आईएएस अधिकारी Abhishek Prakash को बहाल करने का निर्णय लिया है। शासन के सूत्रों के मुताबिक उनकी बहाली 14 मार्च के बाद से प्रभावी मानी जाएगी। हालांकि नियुक्ति विभाग की ओर से इस संबंध में अभी तक कोई आधिकारिक बयान जारी नहीं किया गया है।

2006 बैच के आईएएस अधिकारी अभिषेक प्रकाश इससे पहले निवेश प्रोत्साहन एजेंसी Invest UP के मुख्य कार्यकारी अधिकारी (सीईओ) के पद पर तैनात थे। उन पर एक सोलर कंपनी से प्रोजेक्ट मंजूरी के बदले रिश्वत मांगने के गंभीर आरोप लगे थे। इन आरोपों के बाद प्रदेश सरकार ने 20 मार्च 2025 को उन्हें निलंबित कर दिया था।

इस मामले में फरवरी 2026 में Lucknow Bench of Allahabad High Court ने सुनवाई करते हुए साक्ष्य के अभाव में उनके खिलाफ दाखिल चार्जशीट को निरस्त कर दिया था। अदालत के इस फैसले के बाद उनकी बहाली का रास्ता साफ हो गया।

शासन के सूत्रों के अनुसार निलंबन की अवधि एक वर्ष पूरी होने से पहले इस मामले में रिपोर्ट केंद्र सरकार के कार्मिक मंत्रालय को भेजी जानी है। इसी प्रक्रिया के तहत उनकी बहाली को 14 मार्च के बाद प्रभावी माना जाएगा।

दिल्ली हाई कोर्ट ने शराब नीति मामले में पूर्व मुख्यमंत्री अरविंद केजरीवाल और पूर्व डिप्टी सीएम मनीष सिसोदिया से जवाब मांगा है। सीबीआई की याचिका पर ये जवाब मांगा गया है। हाई कोर्ट ने केजरीवाल और सिसोदिया समेत 23 अन्य लोगों को अधीनस्थ अदालत की ओर से आरोप मुक्त किये जाने के खिलाफ सीबीआई की याचिका पर सोमवार को आरोपियों से उनका पक्ष बताने को कहा।

दिल्ली शराब घोटाला केस की सुनवाई दिल्ली हाईकोर्ट में जस्टिस स्वर्ण कांता शर्मा की बेंच के सामने हुई। जस्टिस स्वर्ण कांता शर्मा ने राउज एवेन्यू कोर्ट को इस मामले से जुड़े मनी लॉन्ड्रिंग केस की सुनवाई तब तक टालने का भी निर्देश दिया, जब तक कि ट्रायल कोर्ट के फैसले के खिलाफ सीबीआई की याचिका पर फैसला नहीं कर लिया जाता।

सॉलीसिटर जनरल तुषार मेहता ने क्या तर्क दिया?

इस दौरान सीबीआई की ओर से सॉलिसिटर जनरल तुषार मेहता ने दलीलें रखीं। मेहता ने तर्क दिया कि आबकारी नीति मामले में अरविंद केजरीवाल और सिसोदिया को आरोप मुक्त करने का निचली अदालत का आदेश अनुचित था और आपराधिक कानून को ही उलट देता है। उन्होंने आरोप लगाया कि शराब नीति का मामला सबसे बड़े घोटालों में से एक था और भ्रष्टाचार का स्पष्ट उदाहरण था। मेहता ने दावा किया कि निचली अदालत ने केजरीवाल, सिसोदिया और अन्य के पक्ष में बिना सुनवाई के आरोप मुक्त करने का आदेश सुना दिया।

वहीं, दिल्ली हाईकोर्ट ने शराब नीति मामले में दिल्ली के पूर्व मुख्यमंत्री अरविंद केजरीवाल, पूर्व उपमुख्यमंत्री मनीष सिसोदिया और 21 अन्य लोगों को ट्रायल कोर्ट द्वारा आरोप मुक्त किये जाने के विरूद्ध सीबीआई की याचिका पर सोमवार को आरोपियों से उनका पक्ष बताने को कहा। याचिका पर सुनवाई के लिए अगली तारीख 16 मार्च तय की।

राउज एवेन्यू कोर्ट ने सभी आरोपियों को किया था बरी

बता दें कि राउज एवेन्यू कोर्ट ने 27 फरवरी को अरविंद केजरीवाल और मनीष सिसोदिया को आबकारी नीति मामले में 23 अन्य लोगों के साथ बरी कर दिया था। केजरीवाल और सिसोदिया को महीनों जेल में रहने के बाद बरी कर दिया गया था। कोर्ट से बरी होने पर आम आदमी पार्टी और इंडिया गठबंधन ने बीजेपी पर राजनीतिक लाभ के लिए केंद्रीय एजेंसियों के इस्तेमाल करने का आरोप लगाया था। अरविंद केजरीवाल का आरोप था कि दिल्ली में सरकार बनाने के लिए बीजेपी ने उनके खिलाफ साजिश रची थी। सीबीआई ने राउज एवेन्यू कोर्ट के फैसले को चुनौती देते हुए हाईकोर्ट में याचिका दाखिल की थी।

रिश्वत आरोप में निलंबित IAS अभिषेक प्रकाश की होगी बहाली, 14 मार्च के बाद से प्रभावी मानी जाएगी
लखनऊ। प्रदेश सरकार ने निलंबित आईएएस अधिकारी Abhishek Prakash को बहाल करने का निर्णय लिया है। शासन के सूत्रों के मुताबिक उनकी बहाली 14 मार्च के बाद से प्रभावी मानी जाएगी। हालांकि नियुक्ति विभाग की ओर से इस संबंध में अभी तक कोई आधिकारिक बयान जारी नहीं किया गया है।

2006 बैच के आईएएस अधिकारी अभिषेक प्रकाश इससे पहले निवेश प्रोत्साहन एजेंसी Invest UP के मुख्य कार्यकारी अधिकारी (सीईओ) के पद पर तैनात थे। उन पर एक सोलर कंपनी से प्रोजेक्ट मंजूरी के बदले रिश्वत मांगने के गंभीर आरोप लगे थे। इन आरोपों के बाद प्रदेश सरकार ने 20 मार्च 2025 को उन्हें निलंबित कर दिया था।

इस मामले में फरवरी 2026 में Lucknow Bench of Allahabad High Court ने सुनवाई करते हुए साक्ष्य के अभाव में उनके खिलाफ दाखिल चार्जशीट को निरस्त कर दिया था। अदालत के इस फैसले के बाद उनकी बहाली का रास्ता साफ हो गया।

शासन के सूत्रों के अनुसार निलंबन की अवधि एक वर्ष पूरी होने से पहले इस मामले में रिपोर्ट केंद्र सरकार के कार्मिक मंत्रालय को भेजी जानी है। इसी प्रक्रिया के तहत उनकी बहाली को 14 मार्च के बाद प्रभावी माना जाएगा।

हालांकि, बहाली के बाद उन्हें किस विभाग या जिम्मेदारी पर तैनात किया जाएगा, इस पर अंतिम निर्णय अभी लिया जाना बाकी है। शासन स्तर पर इस संबंध में विचार-विमर्श जारी है।

दिल्ली हाई कोर्ट ने शराब नीति मामले में पूर्व मुख्यमंत्री अरविंद केजरीवाल और पूर्व डिप्टी सीएम मनीष सिसोदिया से जवाब मांगा है। सीबीआई की याचिका पर ये जवाब मांगा गया है। हाई कोर्ट ने केजरीवाल और सिसोदिया समेत 23 अन्य लोगों को अधीनस्थ अदालत की ओर से आरोप मुक्त किये जाने के खिलाफ सीबीआई की याचिका पर सोमवार को आरोपियों से उनका पक्ष बताने को कहा।

सॉलिसिटर जनरल तुषार मेहता ने रखी दलीलें

दिल्ली शराब घोटाला केस की सुनवाई दिल्ली हाईकोर्ट में जस्टिस स्वर्ण कांता शर्मा की बेंच के सामने हुई। जस्टिस स्वर्ण कांता शर्मा ने राउज एवेन्यू कोर्ट को इस मामले से जुड़े मनी लॉन्ड्रिंग केस की सुनवाई तब तक टालने का भी निर्देश दिया, जब तक कि ट्रायल कोर्ट के फैसले के खिलाफ सीबीआई की याचिका पर फैसला नहीं कर लिया जाता।

सॉलीसिटर जनरल तुषार मेहता ने क्या तर्क दिया?

इस दौरान सीबीआई की ओर से सॉलिसिटर जनरल तुषार मेहता ने दलीलें रखीं। मेहता ने तर्क दिया कि आबकारी नीति मामले में अरविंद केजरीवाल और सिसोदिया को आरोप मुक्त करने का निचली अदालत का आदेश अनुचित था और आपराधिक कानून को ही उलट देता है। उन्होंने आरोप लगाया कि शराब नीति का मामला सबसे बड़े घोटालों में से एक था और भ्रष्टाचार का स्पष्ट उदाहरण था। मेहता ने दावा किया कि निचली अदालत ने केजरीवाल, सिसोदिया और अन्य के पक्ष में बिना सुनवाई के आरोप मुक्त करने का आदेश सुना दिया।

16 मार्च को अगली सुनवाई

वहीं, दिल्ली हाईकोर्ट ने शराब नीति मामले में दिल्ली के पूर्व मुख्यमंत्री अरविंद केजरीवाल, पूर्व उपमुख्यमंत्री मनीष सिसोदिया और 21 अन्य लोगों को ट्रायल कोर्ट द्वारा आरोप मुक्त किये जाने के विरूद्ध सीबीआई की याचिका पर सोमवार को आरोपियों से उनका पक्ष बताने को कहा। याचिका पर सुनवाई के लिए अगली तारीख 16 मार्च तय की।

राउज एवेन्यू कोर्ट ने सभी आरोपियों को किया था बरी

बता दें कि राउज एवेन्यू कोर्ट ने 27 फरवरी को अरविंद केजरीवाल और मनीष सिसोदिया को आबकारी नीति मामले में 23 अन्य लोगों के साथ बरी कर दिया था। केजरीवाल और सिसोदिया को महीनों जेल में रहने के बाद बरी कर दिया गया था। कोर्ट से बरी होने पर आम आदमी पार्टी और इंडिया गठबंधन ने बीजेपी पर राजनीतिक लाभ के लिए केंद्रीय एजेंसियों के इस्तेमाल करने का आरोप लगाया था। अरविंद केजरीवाल का आरोप था कि दिल्ली में सरकार बनाने के लिए बीजेपी ने उनके खिलाफ साजिश रची थी। सीबीआई ने राउज एवेन्यू कोर्ट के फैसले को चुनौती देते हुए हाईकोर्ट में याचिका दाखिल की थी।
