दिल्ली-एनसीआर में आवारा कुत्तों को लेकर सुप्रीम कोर्ट के आदेश के बाद नई बहस छिड़ गई है। कोर्ट ने 8 हफ्ते के अंदर शहर के सारे आवारा कुत्तों को पकड़कर शेल्टर होम्स में डालने का आदेश दिया है। सुप्रीम कोर्ट के इस फैसले से डॉग लवर्स नाराज हैं। उनका कहना है कि सुप्रीम कोर्ट को अपने फैसले पर दोबारा सोचना चाहिए। आवारा कुत्तों को पकड़ने और उन्हें सुरक्षित जगहों पर रखने का मामला चीफ जस्टिस ऑफ इंडिया (सीजेआई) गवई के सामने भी उठाया गया है। इस मुद्दे पर सीजेआ ने अहम टिप्पणी की है। उन्होंने कहा कि वे इस मामले पर गौर करेंगे।

आवारा कुत्तों से जुड़े एक मामले को बुधवार को भारत के मुख्य न्यायाधीश के समक्ष तत्काल सुनवाई के लिए पेश किया गया। याचिका कॉन्फ्रेंस फॉर ह्यूमन राइट्स (इंडिया) नाम के एक संगठन की ओर से 2024 में दायर की गई थी। इसमें दिल्ली हाईकोर्ट के उस आदेश को चुनौती दी गई थी, जिसमें पशु जन्म नियंत्रण (कुत्ते) नियमों के अनुसार दिल्ली में आवारा कुत्तों के नसबंदी और टीकाकरण के निर्देश देने की मांग वाली उनकी जनहित याचिका पर विचार करने से इनकार कर दिया गया था। आज जब यह याचिका सामने लाई गई तो कोर्ट ने कहा कि वह इस पर विचार करेगी।

एक वरिष्ठ वकील ने सीजेआई गवई के समक्ष इस मामले को उठाते हुए सुप्रीम कोर्ट के आदेश पर आपत्ति जताई थी। वकील ने इस मुद्दे पर अदालत के एक पुराने फैसले की तरफ ध्यान दिलाया। पिछले आदेश में बिना वजह कुत्तों को मारने पर रोक लगाई गई थी और सभी जीवों के प्रति करुणा बरतने की बात कही गई थी। इस पर सीजेआई गवई ने कहा, लेकिन दूसरी पीठ पहले ही आदेश दे चुकी है। मैं इस पर गौर करूंगा।  वे न्यायमूर्ति जेबी पारदीवाला की अध्यक्षता वाली पीठ की ओर से 11 अगस्त को दिल्ली में आवारा कुत्तों को आश्रय स्थलों में स्थानांतरित करने के आदेश का जिक्र कर रहे थे।

वकील की दलील पप क्या बोले सीजेआई?
इसके बाद वकील ने न्यायमूर्ति जेके माहेश्वरी की अध्यक्षता वाली पीठ की ओर से मई 2024 में पारित एक आदेश का हवाला दिया, जिसके तहत आवारा कुत्तों के मुद्दे से संबंधित याचिकाओं को संबंधित उच्च न्यायालयों में स्थानांतरित कर दिया गया था। वकील ने न्यायमूर्ति माहेश्वरी की पीठ की ओर से पारित आदेश का का जिक्र किया, जिसमें कोर्ट ने कहा था कि हम बस इतना ही कहना चाहते हैं कि किसी भी परिस्थिति में कुत्तों की अंधाधुंध हत्या नहीं की जा सकती। अधिकारियों को मौजूदा कानूनों और भावना के अनुसार कार्रवाई करनी होगी। इस बात में कोई दो राय नहीं है कि सभी जीवों के प्रति करुणा प्रदर्शित करना संवैधानिक मूल्य और जनभावना है। इसे बनाए रखना अधिकारियों का दायित्व है। तब मुख्य न्यायाधीश गवई ने जवाब दिया, 'मैं इस पर गौर करूंगा।'

सुप्रीम कोर्ट ने क्या दिया था आदेश?
दरअसल जस्टिस जेबी पारदीवाला और जस्टिस आर महादेवन की सुप्रीम कोर्ट बेंच ने दिल्ली-एनसीआर में कुत्तों के काटने से हो रहे रेबीज मामलों, खासकर बच्चों की मौत, को बेहद गंभीर बताते हुए सभी आवारा कुत्तों को जल्द से जल्द शेल्टर होम में शिफ्ट करने का आदेश दिया था। अदालत ने शुरुआती चरण में 5,000 कुत्तों के लिए 6-8 हफ्तों में शेल्टर बनाने का आदेश दिया। कोर्ट ने इसके साथ ही डॉग लवर्स को चेतावनी दी कि इसमें बाधा डालने पर सख्त कार्रवाई होगी, यहां तक कि अवमानना की कार्यवाही भी हो सकती है।

दिल्ली-एनसीआर में आवारा कुत्तों को लेकर सुप्रीम कोर्ट के आदेश के बाद नई बहस छिड़ गई है। कोर्ट ने 8 हफ्ते के अंदर शहर के सारे आवारा कुत्तों को पकड़कर शेल्टर होम्स में डालने का आदेश दिया है। सुप्रीम कोर्ट के इस फैसले से डॉग लवर्स नाराज हैं। उनका कहना है कि सुप्रीम कोर्ट को अपने फैसले पर दोबारा सोचना चाहिए। आवारा कुत्तों को पकड़ने और उन्हें सुरक्षित जगहों पर रखने का मामला चीफ जस्टिस ऑफ इंडिया (सीजेआई) गवई के सामने भी उठाया गया है। इस मुद्दे पर सीजेआ ने अहम टिप्पणी की है। उन्होंने कहा कि वे इस मामले पर गौर करेंगे।

आवारा कुत्तों से जुड़े एक मामले को बुधवार को भारत के मुख्य न्यायाधीश के समक्ष तत्काल सुनवाई के लिए पेश किया गया। याचिका कॉन्फ्रेंस फॉर ह्यूमन राइट्स (इंडिया) नाम के एक संगठन की ओर से 2024 में दायर की गई थी। इसमें दिल्ली हाईकोर्ट के उस आदेश को चुनौती दी गई थी, जिसमें पशु जन्म नियंत्रण (कुत्ते) नियमों के अनुसार दिल्ली में आवारा कुत्तों के नसबंदी और टीकाकरण के निर्देश देने की मांग वाली उनकी जनहित याचिका पर विचार करने से इनकार कर दिया गया था। आज जब यह याचिका सामने लाई गई तो कोर्ट ने कहा कि वह इस पर विचार करेगी।

एक वरिष्ठ वकील ने सीजेआई गवई के समक्ष इस मामले को उठाते हुए सुप्रीम कोर्ट के आदेश पर आपत्ति जताई थी। वकील ने इस मुद्दे पर अदालत के एक पुराने फैसले की तरफ ध्यान दिलाया। पिछले आदेश में बिना वजह कुत्तों को मारने पर रोक लगाई गई थी और सभी जीवों के प्रति करुणा बरतने की बात कही गई थी। इस पर सीजेआई गवई ने कहा, लेकिन दूसरी पीठ पहले ही आदेश दे चुकी है। मैं इस पर गौर करूंगा।  वे न्यायमूर्ति जेबी पारदीवाला की अध्यक्षता वाली पीठ की ओर से 11 अगस्त को दिल्ली में आवारा कुत्तों को आश्रय स्थलों में स्थानांतरित करने के आदेश का जिक्र कर रहे थे।

वकील की दलील पप क्या बोले सीजेआई?
इसके बाद वकील ने न्यायमूर्ति जेके माहेश्वरी की अध्यक्षता वाली पीठ की ओर से मई 2024 में पारित एक आदेश का हवाला दिया, जिसके तहत आवारा कुत्तों के मुद्दे से संबंधित याचिकाओं को संबंधित उच्च न्यायालयों में स्थानांतरित कर दिया गया था। वकील ने न्यायमूर्ति माहेश्वरी की पीठ की ओर से पारित आदेश का का जिक्र किया, जिसमें कोर्ट ने कहा था कि हम बस इतना ही कहना चाहते हैं कि किसी भी परिस्थिति में कुत्तों की अंधाधुंध हत्या नहीं की जा सकती। अधिकारियों को मौजूदा कानूनों और भावना के अनुसार कार्रवाई करनी होगी। इस बात में कोई दो राय नहीं है कि सभी जीवों के प्रति करुणा प्रदर्शित करना संवैधानिक मूल्य और जनभावना है। इसे बनाए रखना अधिकारियों का दायित्व है। तब मुख्य न्यायाधीश गवई ने जवाब दिया, 'मैं इस पर गौर करूंगा।'

सुप्रीम कोर्ट ने क्या दिया था आदेश?
दरअसल जस्टिस जेबी पारदीवाला और जस्टिस आर महादेवन की सुप्रीम कोर्ट बेंच ने दिल्ली-एनसीआर में कुत्तों के काटने से हो रहे रेबीज मामलों, खासकर बच्चों की मौत, को बेहद गंभीर बताते हुए सभी आवारा कुत्तों को जल्द से जल्द शेल्टर होम में शिफ्ट करने का आदेश दिया था। अदालत ने शुरुआती चरण में 5,000 कुत्तों के लिए 6-8 हफ्तों में शेल्टर बनाने का आदेश दिया। कोर्ट ने इसके साथ ही डॉग लवर्स को चेतावनी दी कि इसमें बाधा डालने पर सख्त कार्रवाई होगी, यहां तक कि अवमानना की कार्यवाही भी हो सकती है।
