सुप्रीम कोर्ट की पांच सदस्यीय संविधान पीठ ने गुरुवार को राष्ट्रपति की ओर से संविधान के अनुच्छेद 143 के तहत मांगी गई राय पर अपना फैसला सुना दिया है। सीजेआई के नेतृत्व वाली पांच जजों की संविधान पीठ ने कहा कि राज्यपाल पर कोई समय-सीमा नहीं लगा सकता। अदालत ने राष्ट्रपति के रेफरेंस पर अपनी राय देते हुए कहा है कि राष्ट्रपति और राज्यपालों को विधेयकों को मंजूरी देने के लिए समय सीमा तय करने वाला फैसला असंवैधानिक है।

समय सीमा में बांधना संविधान की भावना के विपरीत
राष्ट्रपति द्रौपदी मुर्मू की ओर से भेजे गए प्रेजिडेंशियल रेफरेंस पर कोर्ट ने गुरुवार को अपनी राय देते हुए कहा कि संविधान के अनुच्छेद 200/201 के तहत कोर्ट बिल पर फैसला लेने के लिए राज्यपाल और राष्ट्रपति के लिए समयसीमा निर्धारित नहीं कर सकता है। उन्होंने कहा कि विधेयक पर फैसला लेने के लिए उन्हें समय सीमा में बांधना संविधान की भावना के विपरीत होगा।

राज्यपालों के पास तीन विकल्प
मुख्य न्यायाधीश भूषण रामकृष्ण गवई, जस्टिस सूर्यकांत, जस्टिस विक्रम नाथ, जस्टिस पी एस नरसिम्हा और जस्टिस ए एस चंदुरकर की बेंच ने कहा कि अनुच्छेद 200 के तहत व्यवस्था है कि राज्यपाल विधेयक को मंजूरी दे सकते हैं, विधानसभा को दोबारा भेज सकते हैं या राष्ट्रपति को भेज सकते हैं। अगर विधानसभा किसी बिल को वापस भेजे तो राज्यपाल को उसे मंजूरी देनी होती है।

विधेयकों को रोकने की अनुमति देना संघवाद के हित के खिलाफ
सुप्रीम कोर्ट ने कहा कि यदि राज्यपाल विधानसभा द्वारा पारित विधेयकों को संविधान के अनुच्छेद 200 के तहत निर्धारित प्रक्रिया का पालन किए बिना रोक कर रखते हैं तो यह संघवाद की भावना के खिलाफ होगा। सुप्रीम कोर्ट ने 'राष्ट्रपति संदर्भ' मामले में कहा हमारे जैसे लोकतांत्रिक देश में राज्यपालों के लिए समयसीमा तय करना संविधान द्वारा प्रदत्त लचीलेपन की भावना के खिलाफ है। सुप्रीम कोर्ट ने कहा कि हमें नहीं लगता कि राज्यपालों के पास राज्य विधानसभा से पारित विधेयकों को लंबित रखने का असीमित अधिकार है। विधेयकों को रोकने की अनुमति दी जाती है तो यह संघवाद के हित के खिलाफ।

राज्यपाल के अधिकारों का उपयोग न्यायिक समीक्षा के दायरे में नहीं
इसके साथ ही कोर्ट ने यह भी रेखांकित किया कि अत्यधिक देरी लोकतांत्रिक शासन की आत्मा को क्षति पहुंचाती है, इसलिए इन पदों से अपेक्षा है कि वे उचित समय के भीतर निर्णय लें। दरअसल, सुप्रीम कोर्ट की संविधान पीठ ने तमिलनाडु के मामले में राज्य के राज्यपाल द्वारा रोक कर रखे गए विधेयकों को शीर्ष अदालत द्वारा 8 अप्रैल को दी गई मान्य स्वीकृति को भी अनुचित बताया। शीर्ष अदालत ने यह भी फैसला दिया कि अनुच्छेद 200 के तहत राज्यपाल के अधिकारों का उपयोग न्यायिक समीक्षा के दायरे में नहीं आता।

अपने ही डबल बेंच की राय को भी खारिज किया
इसके अलावा सुप्रीम कोर्ट ने अपने ही डबल बेंच की राय को भी खारिज कर दिया जिसमें कहा गया था कि राष्ट्रपति को उनके पास भेजे गए किसी विधेयक की संवैधानिकता पर सुप्रीम कोर्ट से अनुच्छेद 143 के तहत राय लेनी चाहिए। सुप्रीम कोर्ट ने स्पष्ट कहा कि राष्ट्रपति को ऐसी कोई राय लेने के लिए बाध्य नहीं किया जा सकता। सुप्रीम कोर्ट ने अपने फैसले में ये भी कहा कि यद्यपि संवैधानिक न्यायालय राज्यपाल के कार्यों पर सीधे सवाल नहीं उठा सकते, लेकिन यदि राज्यपाल किसी विधेयक के उद्देश्यों को विफल करने के लिए लंबे समय तक कार्रवाई न करें, तो ऐसी लंबी देरी की न्यायिक समीक्षा सीमित परिस्थितियों में की जा सकती है। अदालत यह जांच कर सकती है कि देरी जानबूझकर की गई थी या नहीं।

रांची:नामकुम स्थित आईपीएच सभागार में राज्य स्तरीय पुरुष नसबंदी अभियान सह सम्मान समारोह का आयोजन किया गया। स्वास्थ्य मंत्री डॉ. इरफान अंसारी ने कार्यक्रम का शुभारंभ करते हुए कहा कि परिवार नियोजन केवल जनसंख्या नियंत्रण का नहीं, बल्कि स्वस्थ परिवार और सुरक्षित मातृत्व की दिशा में एक बड़ा कदम है।
उन्होंने कहा कि पुरुषों की समान भागीदारी से ही यह प्रयास सफल होगा। डॉ. अंसारी ने सभी से इस अभियान को जन आंदोलन के रूप में आगे बढ़ाने का आह्वान किया।

स्वास्थ्य मंत्री ने कहा कि यह अभियान राज्य के परिवार कल्याण कार्यक्रम की दिशा में एक महत्वपूर्ण कदम है। परिवार नियोजन केवल जनसंख्या नियंत्रण का विषय नहीं है बल्कि यह स्वस्थ परिवार, सुरक्षित मातृत्व और खुशहाल समाज की दिशा में उठाया गया एक सशक्त कदम है। इसका उद्देश्य यह सुनिश्चित करना है कि हर बच्चा योजना और तैयारी के साथ इस दुनिया में आए, और हर मां को सुरक्षित मातृत्व का अधिकार मिले।

माननीय मंत्री द्वारा राज्य का पहला राँची सदर अस्पताल जिसको एनएबीएल सर्टिफिकेट से नवाजा गया है। यह सर्टिफिकेट राज्य के नोडल पदाधिकारी पदाधिकारी, राज्य परामर्शी PHQA एवं राँची सिविल सर्जन, रांची सदर अस्पताल के उपाधीक्षक एवं सभी कर्मियों के प्रयासों से मिला है ।

डाक विभाग के साथ एमओयू पर हस्ताक्षर

इस अवसर पर भारतीय डाक विभाग, झारखंड परिमंडल और राष्ट्रीय स्वास्थ्य मिशन (एनएचएम), झारखंड सरकार के बीच परिवार नियोजन सामग्रियों के परिवहन एवं वितरण हेतु समझौता ज्ञापन (एमओयू) पर हस्ताक्षर किए गए।
इसके तहत डाक विभाग अपने इंडिया पोस्ट पार्सल नेटवर्क के माध्यम से सामग्रियों की समयबद्ध आपूर्ति राज्यभर के स्वास्थ्य केंद्रों तक सुनिश्चित करेगा।
यह पहल “स्वस्थ झारखंड, सुखी झारखंड” के लक्ष्य को सशक्त बनाएगी।

सुप्रीम कोर्ट की पांच सदस्यीय संविधान पीठ ने गुरुवार को राष्ट्रपति की ओर से संविधान के अनुच्छेद 143 के तहत मांगी गई राय पर अपना फैसला सुना दिया है। सीजेआई के नेतृत्व वाली पांच जजों की संविधान पीठ ने कहा कि राज्यपाल पर कोई समय-सीमा नहीं लगा सकता। अदालत ने राष्ट्रपति के रेफरेंस पर अपनी राय देते हुए कहा है कि राष्ट्रपति और राज्यपालों को विधेयकों को मंजूरी देने के लिए समय सीमा तय करने वाला फैसला असंवैधानिक है।

समय सीमा में बांधना संविधान की भावना के विपरीत
राष्ट्रपति द्रौपदी मुर्मू की ओर से भेजे गए प्रेजिडेंशियल रेफरेंस पर कोर्ट ने गुरुवार को अपनी राय देते हुए कहा कि संविधान के अनुच्छेद 200/201 के तहत कोर्ट बिल पर फैसला लेने के लिए राज्यपाल और राष्ट्रपति के लिए समयसीमा निर्धारित नहीं कर सकता है। उन्होंने कहा कि विधेयक पर फैसला लेने के लिए उन्हें समय सीमा में बांधना संविधान की भावना के विपरीत होगा।

राज्यपालों के पास तीन विकल्प
मुख्य न्यायाधीश भूषण रामकृष्ण गवई, जस्टिस सूर्यकांत, जस्टिस विक्रम नाथ, जस्टिस पी एस नरसिम्हा और जस्टिस ए एस चंदुरकर की बेंच ने कहा कि अनुच्छेद 200 के तहत व्यवस्था है कि राज्यपाल विधेयक को मंजूरी दे सकते हैं, विधानसभा को दोबारा भेज सकते हैं या राष्ट्रपति को भेज सकते हैं। अगर विधानसभा किसी बिल को वापस भेजे तो राज्यपाल को उसे मंजूरी देनी होती है।

विधेयकों को रोकने की अनुमति देना संघवाद के हित के खिलाफ
सुप्रीम कोर्ट ने कहा कि यदि राज्यपाल विधानसभा द्वारा पारित विधेयकों को संविधान के अनुच्छेद 200 के तहत निर्धारित प्रक्रिया का पालन किए बिना रोक कर रखते हैं तो यह संघवाद की भावना के खिलाफ होगा। सुप्रीम कोर्ट ने 'राष्ट्रपति संदर्भ' मामले में कहा हमारे जैसे लोकतांत्रिक देश में राज्यपालों के लिए समयसीमा तय करना संविधान द्वारा प्रदत्त लचीलेपन की भावना के खिलाफ है। सुप्रीम कोर्ट ने कहा कि हमें नहीं लगता कि राज्यपालों के पास राज्य विधानसभा से पारित विधेयकों को लंबित रखने का असीमित अधिकार है। विधेयकों को रोकने की अनुमति दी जाती है तो यह संघवाद के हित के खिलाफ।

राज्यपाल के अधिकारों का उपयोग न्यायिक समीक्षा के दायरे में नहीं
इसके साथ ही कोर्ट ने यह भी रेखांकित किया कि अत्यधिक देरी लोकतांत्रिक शासन की आत्मा को क्षति पहुंचाती है, इसलिए इन पदों से अपेक्षा है कि वे उचित समय के भीतर निर्णय लें। दरअसल, सुप्रीम कोर्ट की संविधान पीठ ने तमिलनाडु के मामले में राज्य के राज्यपाल द्वारा रोक कर रखे गए विधेयकों को शीर्ष अदालत द्वारा 8 अप्रैल को दी गई मान्य स्वीकृति को भी अनुचित बताया। शीर्ष अदालत ने यह भी फैसला दिया कि अनुच्छेद 200 के तहत राज्यपाल के अधिकारों का उपयोग न्यायिक समीक्षा के दायरे में नहीं आता।

अपने ही डबल बेंच की राय को भी खारिज किया
इसके अलावा सुप्रीम कोर्ट ने अपने ही डबल बेंच की राय को भी खारिज कर दिया जिसमें कहा गया था कि राष्ट्रपति को उनके पास भेजे गए किसी विधेयक की संवैधानिकता पर सुप्रीम कोर्ट से अनुच्छेद 143 के तहत राय लेनी चाहिए। सुप्रीम कोर्ट ने स्पष्ट कहा कि राष्ट्रपति को ऐसी कोई राय लेने के लिए बाध्य नहीं किया जा सकता। सुप्रीम कोर्ट ने अपने फैसले में ये भी कहा कि यद्यपि संवैधानिक न्यायालय राज्यपाल के कार्यों पर सीधे सवाल नहीं उठा सकते, लेकिन यदि राज्यपाल किसी विधेयक के उद्देश्यों को विफल करने के लिए लंबे समय तक कार्रवाई न करें, तो ऐसी लंबी देरी की न्यायिक समीक्षा सीमित परिस्थितियों में की जा सकती है। अदालत यह जांच कर सकती है कि देरी जानबूझकर की गई थी या नहीं।

रांची:नामकुम स्थित आईपीएच सभागार में राज्य स्तरीय पुरुष नसबंदी अभियान सह सम्मान समारोह का आयोजन किया गया। स्वास्थ्य मंत्री डॉ. इरफान अंसारी ने कार्यक्रम का शुभारंभ करते हुए कहा कि परिवार नियोजन केवल जनसंख्या नियंत्रण का नहीं, बल्कि स्वस्थ परिवार और सुरक्षित मातृत्व की दिशा में एक बड़ा कदम है।
उन्होंने कहा कि पुरुषों की समान भागीदारी से ही यह प्रयास सफल होगा। डॉ. अंसारी ने सभी से इस अभियान को जन आंदोलन के रूप में आगे बढ़ाने का आह्वान किया।

स्वास्थ्य मंत्री ने कहा कि यह अभियान राज्य के परिवार कल्याण कार्यक्रम की दिशा में एक महत्वपूर्ण कदम है। परिवार नियोजन केवल जनसंख्या नियंत्रण का विषय नहीं है बल्कि यह स्वस्थ परिवार, सुरक्षित मातृत्व और खुशहाल समाज की दिशा में उठाया गया एक सशक्त कदम है। इसका उद्देश्य यह सुनिश्चित करना है कि हर बच्चा योजना और तैयारी के साथ इस दुनिया में आए, और हर मां को सुरक्षित मातृत्व का अधिकार मिले।

उन्होंने कहा कि हम यह भी जानते हैं कि परिवार नियोजन की जिम्मेदारी अक्सर महिलाओं तक सीमित रह जाती है, लेकिन अब समय आ गया है कि पुरुष भी समान रूप से इस जिम्मेदारी को साझा करें। नसबंदी एक सुरक्षित, सरल और प्रभावी उपाय है  और इसके प्रति समाज में जो गलत फहमियाँ हैं, उन्हें दूर करना हम सबकी जिम्मेदारी है।
डॉक्टर इरफान अंसारी ने कहा कि  इस समारोह में जिन जिलों और स्वास्थ्य संस्थानों को सम्मानित किया जा रहा है. उन्होंने अपने समर्पण, नवाचार और मेहनत से परिवार नियोजन कार्यक्रम को एक नई दिशा दी है।  सभी विजेता प्रतिभागियों को उन्होंने बधाई दी और कहा कि आपकी यह उपलब्धि न केवल आपके जिले के लिए, बल्कि पूरे राज्य के लिए गर्व की बात है। इस अभियान की उपलब्धि को हासिल करने में जो संस्थान, चिकित्सक या कमी पीछे रह गए हैं, उन्हें प्रोत्साहित करते हुए मैं चाहता हूं कि आप सब अपना पूरा योगदान देकर इस अभियान को सफल बनाने में अपनी भूमिका अदा करें।
डॉक्टर अंसारी ने बताया कि राज्य में स्वास्थ्य सेवाओं को बेहतर करने के लिए 8500  हेल्थ टेक्निकल और नॉन टेक्निकल स्वास्थ्यकर्मियों की बहाली की जाएगी।

माननीय मंत्री द्वारा राज्य का पहला राँची सदर अस्पताल जिसको एनएबीएल सर्टिफिकेट से नवाजा गया है। यह सर्टिफिकेट राज्य के नोडल पदाधिकारी पदाधिकारी, राज्य परामर्शी PHQA एवं राँची सिविल सर्जन, रांची सदर अस्पताल के उपाधीक्षक एवं सभी कर्मियों के प्रयासों से मिला है ।

डाक विभाग के साथ एमओयू पर हस्ताक्षर

इस अवसर पर भारतीय डाक विभाग, झारखंड परिमंडल और राष्ट्रीय स्वास्थ्य मिशन (एनएचएम), झारखंड सरकार के बीच परिवार नियोजन सामग्रियों के परिवहन एवं वितरण हेतु समझौता ज्ञापन (एमओयू) पर हस्ताक्षर किए गए।
इसके तहत डाक विभाग अपने इंडिया पोस्ट पार्सल नेटवर्क के माध्यम से सामग्रियों की समयबद्ध आपूर्ति राज्यभर के स्वास्थ्य केंद्रों तक सुनिश्चित करेगा।
यह पहल “स्वस्थ झारखंड, सुखी झारखंड” के लक्ष्य को सशक्त बनाएगी।

परिवार नियोजन सेवाओं को और सशक्त बनाएगी सरकार – अजय कुमार सिंह

अपर मुख्य सचिव श्री अजय कुमार सिंह ने कहा कि परिवार नियोजन केवल स्वास्थ्य कार्यक्रम नहीं, बल्कि सामाजिक और आर्थिक प्रगति का आधार है। उन्होंने सर्जन, एएनएम, जीएनएम और सीएचओ की भूमिका की सराहना करते हुए कहा कि सामूहिक प्रयासों से झारखंड पुरुष सहभागिता आधारित परिवार नियोजन में आदर्श राज्य बनेगा।



सुरक्षित और प्रभावी उपाय है पुरुष नसबंदी – शशि प्रकाश झा

राष्ट्रीय स्वास्थ्य मिशन के अभियान निदेशक श्री शशि प्रकाश झा ने बताया कि राज्य की कुल प्रजनन दर (TFR) 3.5 से घटकर 2.3 और गर्भनिरोधक प्रचलन दर (CPR) 35.7% से बढ़कर 61.7% हो चुकी है। उन्होंने कहा कि अब पुरुषों की सक्रिय भागीदारी आवश्यक है, क्योंकि पुरुष नसबंदी एक सुरक्षित, सरल और प्रभावी उपाय है।

राज्य में परिवार नियोजन संकेतकों में सुधार – डॉ. पुष्पा

राज्य नोडल पदाधिकारी डॉ. पुष्पा ने कहा कि झारखंड में परिवार नियोजन के संकेतकों में उल्लेखनीय सुधार हुआ है। Unmet Need घटकर 10% रह गई है और अस्थायी विधियों के उपयोग में बढ़ोतरी हुई है। उन्होंने कहा कि यह केवल स्वास्थ्य कार्यक्रम नहीं, बल्कि समानता और जिम्मेदारी का अभियान है।

नई विधियों का शुभारंभ और सम्मान समारोह

कार्यक्रम के दौरान गर्भनिरोधक की नई विधियों (MPA-SC एवं इम्प्लांट) का शुभारंभ किया गया तथा सहिया के लिए तैयार वीडियो फिल्म का विमोचन हुआ।
राज्यभर के उत्कृष्ट प्रदर्शन करने वाले स्वास्थ्यकर्मियों एवं संस्थानों को सम्मानित किया गया, जिनमें —
